By using the globalyogaschools.com website, Mobile Application hereinafter referred as “Platform”, you signify your agreement to be bound by these conditions mentioned in and as “Terms & Conditions for Usage” or “Terms of Usage” or “Conditions of Usage”. Bipartite agreement mentions the terms and conditions between ‘Buyer or Student or Trainee or who use this platform for learning and certification’ and ‘Seller or Tutor or Faculty or Teacher or Lecturer or Trainer or Professional or who uses this platform for teaching purposes – or with same meaning in any other words. This agreement consists of “Privacy Policy” mentioned under “privacy”.

Yuvaan IT Labs Private Limited “here-in-after referred as GYS”, GYS is a registered trademark of Yuvaan Group of companies and its affiliated partners will provide access to the globalyogaschools.com website, mobile site and mobile applications used in Android or iOS or any other Operating System technology used in mobiles, electronic gadgets (website, mobile site and mobile application are here-in-after referred as “platform”) to you subject to the conditions set out on this page for public use before going to use our platform. This agreement mentions about the Conditions of usage of website and Conditions of sale on this platform. Every Buyer means a ‘Customer or Student or Trainee or who uses platform for learning and certification’ and Seller means a ‘Tutor or Faculty or Teacher or Lecturer or Trainer or Professional or who uses platform for teaching purposes – or with same meaning in any other words’ are bound to or by all the Terms & Conditions for Usage of platform as mentioned here.

• For the purpose of these Terms of Use, wherever the context so requires “You” or “User” or “Your” shall mean any natural or legal person who has agreed to become a Buyer or customer using to buy and ‘Seller or Tutor or Faculty or Teacher or Lecturer or Trainer or Professional or who uses platform for teaching purposes – or with same meaning in any other words’ or customer using to sell on the Platform by providing Registration Data while registering on the Platform as Registered User using the computer systems. GYS allows the User to surf the Platform or making purchases without registering on the Platform, ‘Seller or Tutor or Faculty or Teacher or Lecturer or Trainer or Professional or who uses platform for teaching purposes – or with same meaning in any other words’ have to register to sell his products this platform. The term “We”, “Us”, “Our” shall mean Yuvaan IT Labs Private Limited. (Note: Buyer or Customer means “Buyer” – who uses this platform for purchasing or buying of products or services, where as “Seller” – Seller comes under customer to GYS, but “Seller”- who uses this platform for selling of products or services to the buyers who registered on this platform.)
• You agree that by accessing the platform, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the platform and you must discontinue use immediately.
• In addition, when you use any current or future platform services like Wish List, e-Market place, e-commerce website or e-commerce mobile application or Market place or e-commerce platform etc., (“GYS Service”), you will also be subject to the terms, guidelines and conditions applicable to that GYS Service. (“Terms”). If these Conditions of Use are inconsistent with such Terms, the Terms will control.
• This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000, India. • “Platform” is owned by Yuvaan IT Labs Private Limited a company incorporated under the Companies Act, 1956 in India with its registered office at Parachurivari Street, Nawabpeta, Nellore City, SPSR Nellore District – 524002, Andhra Pradesh, India and it’s branch offices at Balaramnagar, Besides Shiva Temple, Near to Narayana Engineering College, Nellore City, SPSR Nellore District – 524003, Andhra Pradesh, India (hereinafter referred to as “GYS”).
• Your use of the Platform and services and tools are governed by the following GYS Terms & Conditions for Usage of globalyogaschools.com, mobile application (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with GYS and these terms and conditions including the policies constitute Your binding obligations, with GYS. Bipartite agreement mentions the terms and conditions between Buyer and seller.
• When You use any of the services provided by Us through the Platform, including but not limited to, (Example: Course – recommendations, Advertisements, published content; Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms and conditions (Terms or conditions) applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

Conditions to Use Platform

1. Your Account: If you use the platform, you are responsible for maintain the confidentiality about your user’s name and password. It is your responsible to safeguard them. You agree to create your account using your email id or contact number, and to provide your details about address and any related information which is required to register collect or to deliver the product from your location, to provide your correct and active bank details to refund (in case of UPI or Online Banking) to platform provider of buyer or to collect the sale amount (sale amount = product or service cost – (Taxes + fees + commission + Shipping cost-if applicable) by seller after completions of return policy period as per seller’s agreement. Buyer has to create an account under student page and Seller at our instructor signup page. Seller account activation will be subject to documents which they have produced for verification to make use of our platform. It is your responsibility to restrict your devices to prevent from unauthorised access to your account and any related information which comes under this agreement. If you allow others to use your account, you are completely responsible for any fraud or illegal or any wrong transaction happened, in such cases We are not responsible or made liable for any losses incurred to you.

• Transaction (include both buying and selling of services or products or both only in digital format and products which are not able to ship physically) on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e., under the age of 18 years, you may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian. If you are minor as per India Laws, all the transactions to be made by your parents or legal guardians. It is your responsible to intimate us about any unauthorised access to your account. Please ensure that all the information about you provided with us are correct and you have to inform us if any changes were made in it through your My Account area on platform. This platform is a platform where users can utilise their scope to sale or purchase the products with one another for their transactions.
• GYS is not a part or party in between users, and we do not have any control in any manner between users for transactions. You agree and acknowledge that you use this account for “buyer use our platform to Purchase of product or services for personal not for business purpose, seller use our platform to sell his product or services which are legal to sell on such platform as per India Laws”. You shall be solely liable for all compliances required under applicable laws. You agree, understand and acknowledge that we are giving our services on this platform in and across India as well as globally, in case of selling any physical product we are shipping within India and globally as per our delivery partners locations and selected locations only (delivery Pin Code Base). But we are not providing any services for selling of physical products where it’s a completely edtech platform sells only digital content.
• GYS has the right not to allow business purchases on the Platform to You if a fraudulent activity is identified. Seller reserves the right to not issue Tax Invoice or issue a credit note against an already issued Tax Invoice to cancel the transaction, if any fraudulent activity is identified. You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the seller(s) that You transact with. GYS reserves the right to refuse access to the platform, terminate accounts, remove or edit content at any time without any notice to you.

2. Privacy (Privacy Policy): SOME CONTENT OFFERED ON THE PLATFORM MAY NOT BE SUITABLE FOR SOME VIEWERS AND THEREFORE VIEWER DISCRETION IS ADVISED. This disclosure may be required for us to provide you access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose your personal information to third parties for their marketing and advertising purposes without your explicit consent. These entities and affiliates may market to you as a result of such sharing unless you explicitly opt-out. In case of certification, we provide details of some certified students details publicly visible to everyone. Tutor details will made visible to everyone with their full profile and contact details if necessary. We have to share details of the students to tutors whenever it is necessary to complete their course and certification.
   • Registration of user Globally: You agree and authorise Us to collect your information like Name, Address, Email Id, Contact Number, Education Qualification, complete candidate profile and any other information which is helpful for student identity and to give services to you, you agree to share your information to other affiliate members likes tutors, delivery agency in case of physical products and to third party who give services to us on this platform, Payment Purpose: In case of any payments (payment to purchased service or product by buyer or Refund to Buyer and Payment to sellers for the sale product or service on this platform as per policy by excluding any taxes, Fees, Charges) or any information helpful to do payments to you (like Bank Account, IFSC Code, Bank & Branch Details, PAN Card Number, Identification Card like Aadhar, GSTIN Details). We and our employees or members won’t ask for any bank OTPs, CVV numbers or any such Confidential information. Our trusted payment gate way partners will ask for your information to process payments, before doing such transactions refer to payment gate way partners Terms of usage, Privacy policy, Cookie’s policy and which may to be consider as per Indian Laws. GYS or its members are not liable for any losses or damages or fraud transaction done on this platform.
   • We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.
   • We and our affiliates will share / sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Your Conduct to use Platform: You (user or buyer or Seller or any one which comes in the same meaning) are not allowed to use, host, display, upload, modify, publish, transmit, update or share this platform, which causes or likely to cause, the platform or to a part of it to be damages or interrupted, or impaired in any way that you understand, and not GYS is not responsible for all electronics communication and any content sent from your computer or mobile to us and you have to abide by all the terms & Condition of usage to use this platform for lawful purpose only. You must not use this platform for any purpose which may cause the harm to any person or legally formed person or fraudulent purpose or for cheating the users, or in connection with any criminal offence or other unlawful activities. You are not allowed to sell or buy any type of banned or prohibited or which in same sense as per India Laws or to use the platform for promoting such products or contents. You are not allowed to use, host, display, upload, modify, publish, transmit, update or share or make use of any material, content or product or services which are harming minors, violates any law in time being in force, which contains sexual contents, sexual harassment, contains illegal actives, any junk mail, or not to promote any information related to illegal activities such as selling or buying illegal weapons, or creating viruses to harm any other by clicking or downloading such contents, prohibited matter contains in videos, photographs, or commercial solicitation, abusive, chain letter, mass mailing, or any spam, any political harassment,  harasses or advocates harassment or another or impersonate any persons or causes damages or gambling and so, unauthorised access to platform for illegal profits, not false, inaccurate or misleading or threatens the unity and integrity of nation or with foreign nations or person or so, to the dignity of any company or any person or any legally forming body and images of any persons (with a minor or an adult).  You are not allowed to use this platform which effects the copy right, Trade mark Right or any other material related and may leads to infringement.
   • You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the Platform or any service offered on or through the Platform. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity. You may not use the Platform or any content for any purpose that is unlawful or prohibited by these Terms & Conduct of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of GYS and / or others. You are liable for any violations in the usage of platform, GYS is not liable for any losses, damages or in form or any which may to be consider as unlawful as per Indian Laws.

4. Children or Minor: SOME CONTENT OFFERED ON THE PLATFORM MAY NOT BE APPROPRIATE FOR VIEWERSHIP BY CHILDREN. PARENTS AND/OR LEGAL GUARDIANS ARE ADVISED TO EXERCISE DISCRETION BEFORE ALLOWING THEIR CHILDREN AND/OR WARDS TO ACCESS CONTENT ON THE PLATFORM.

However due to act of god, nature calamities, and due to nature of internet, this cannot be guaranteed. Your access to platform may also be occasionally suspended or restricted to allow us for updates, repair, maintenance, or introduction to new facilities or services at any time without any prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. We are not liable for any inconvenience happen to you in use of this platform.

Any unauthorised use terminates the permission or license granted by Yuvaan IT Labs Private Limited and / or its affiliates, as applicable. Claims against Objectionable Content: GYS lists several products for sale offered by sellers on the platform and hosts many of comments, it is not possible for us to be aware of the contents of each product listed for sale, or each comment or review that is displayed. Accordingly, GYS or globalyogaschools.com operates on a “notice and takedown” basis. If you believe that any content on the platform is offensive and illegal (including but not limited to material that is sexually explicit content or physical harm or which promotes racism, hatred, bigotry), deceptive, misleading, abusive, indecent, harassing, libellous, defamatory, paedophilic or menacing, obscene, pornographic; blasphemous, ethnically objectionable, disparaging; or relates to or promotes money laundering or gambling; or threatens the unity, integrity, security or sovereignty of India or friendly relations with foreign States; or is otherwise injurious to third parties; or is harmful to minors in any way; or impersonates another person; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, (“Objectionable Content”), please notify us immediately by infringement@globalyogaschools.com. SELLING: You as registered seller on our platform, you are allowed and permitted to make use of our platform to list item(s) or services which are legally allowed as per India laws and respective state laws for sale on the Platform in accordance with the Policies which are incorporated by way of reference in this Terms & Conditions of Use. You must be legally able to sell the item(s) you list for sale on our Platform. You must ensure that the listed items do not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties or consent Brands. Listings may only include text descriptions, graphics and pictures that describe your item for sale. All listed items must be listed in an appropriate category on the Platform. All listed items must be kept in ready stock for successful fulfilment of sales. The listing description of the item must not be misleading and must describe actual condition of the product. If the item description does not match the actual condition of the item, you agree to refund any amounts that you may have received from the Buyer. You agree not to list a single product in multiple quantities across various categories on the Platform. GYS reserves the right to delete such multiple listings of the same product listed by you in various categories and to delete them on our platform. You agree to take orders, process it with proper packing and Bills (GST or any applicable bills in support to ship), shipping on your own courier partner or our courier partner (GYS is not allowing the sellers to charge any shipping fee from buyers), to replace or refund as case may deemed fit to buyer who purchase your product on this platform. You agree to pay all the fees, commissions, taxes which are applicable as per Indian laws for make use of platform to us. You agree to list and sell all the products which are in not used condition and sealed as it is received from company and the said product is not a refurbished one. This platform not allows to sale any refurbished products, if we receive any complaint or any feedback or may come to our finding which confirms that it is not as original then seller will be made liable for any losses or damages or any such caused to buyer or to us as per Indian Laws. GYS is not liable for any such frauds, copy rights, Intellectual Property Rights or any Infringements or violation of any terms as mentioned in terms and conditions of usage were happen through this platform. For selling any course on this platform the GST will be charged in either way as by seller or by the platform provider for any courses or downloadable content. Seller acknowledges and agree to the conditions before registering as a seller on our platform.

If any such acts will come to our notice the tutor account will be deactivated and we remove their content on our website, in case of any payments due to the tutor from the platform provider such amount will be refunded to students as per the refund policy. Tutor cannot make any claims against the losses which were incurred to him in getting pay-out from platform provider in any form when such illegal acts were done. Tutor and Student accepts that platform provider does not make liable for any such losses or incidents happen to students with the acts of tutor.

Problems like wrong items received, item not as described, Damaged or Seal Broke on product at time of receive, part or accessories are missing, item not compatible (it under the discretion of GYS), seller discerption/specification wrong at product specification page, Defective (Functional Issue), Product not working and manufacturer claims invalid invoice. If seller may reject the replacement or return request for the valid reason by buyer may raise a dispute to us. Buyer or seller may bring any fraudulent action or likely to be same will bring to our notice as a dispute. Any damage or loss to the product after delivery in the hands of buyer may not be claimable under this dispute, if any damage was observed or identified at time of delivery the buyer can refuse the order to accept. GYS is not responsible or liable at any point for any direct or indirect losses, expenses, costs of any nature such things have to be incurred by the buyer or seller. Disputes raised at time of payment will not be resolved under this DPR, they have to contact concern bank or service provider directly. Decision taken by GYS is final and binding on its users. GYS customer care team will ask for more information if so needed to resolve issue, any of buyer or seller won’t respond within 5 days the issue will be auto closed.

Seller agrees to give correct and complete invoices to the buyers, any discrepancy found or occurred seller is completely responsible for it. Seller is liable and responsible to losses or damages or any incurred to buyer due to incorrect invoice.

Tutor made liable against any act of stalking, harassment, personally contacting the student, asking for personal needs, or contacting the student in any form for any benefits as per Indian laws. If any such acts will come to our notice the tutor account will be deactivated and we remove their content on our website, in case of any payments due to the tutor from the platform provider such amount will be refunded to students as per the refund policy. Tutor cannot make any claims against the losses which were incurred to him in getting pay-out from platform provider in any form when such illegal acts were done. Tutor and Student accepts that platform provider does not make liable for any such losses or incidents happen to students with the acts of tutor.

34. Cancellation & Refund Policy

Price: Fee for the course shown on our platform are all inclusive of GST as per Indian Laws. Base fee is inclusive of actual fee and convenience fee. User has to pay the exchange charges in addition to the Price of the product by international users.

Price (Total course Fee) = Actual Fee + GST + Payment Gateway Charges (PGC) if any

Cancellation of Order

• Cancellation of order by buyer: Cancellation will not be allowed once sellers confirm the order. Cancellation of the product will be allowed before the product has been confirmed by the seller, once the course commencement procedure starts the buyer not able to cancel the ordered product or service which they have ordered.
• Cancellation of enrolled course (if applicable): Cancellation or withdrawing from the course will be calculated and refund will be processed as per the below method:

• No refund to users out of India will be allowed once the order has been confirmed in any form.
• Refund policy is only applicable to virtual trainings, tuitions, one-to-one trainings (applicable only if refundable option is provided by the seller) Refund policy is not applicable to the services (Payments once made were not refundable) comes under assessments, certifications exam fee, one-to-one training (not applicable if it a complete onetime fee not refundable), awareness programs, entrepreneur trainings, life skills workshops, education admissions, collection of exam fee, hackathons, coding clubs, memberships, subscription, registration for edtech fairs, technical fest registrations, journals & paper publications, affiliated course selling or which comes under the same meaning.

• Cancellation of order by seller: It is under the sole discretion of seller to accept cancelling the order on his own at any time for any reason. GYS or its associates or its partners are not liable for any losses or damages caused to buyer due to cancellation of order by seller.
• Return or Replacement or Refund or Exchange: GYS is not liable for any damages caused to buyer because of seller violating RRRE policy, GYS may share the details of seller to such buyer to resolve their dispute. GYS is not facilitating any Buyer protection Program bit we may try our level best to clear the dispute which brings to our notice through mail disputes@globalyogaschools.com, GYS is only platform provider.

In case of international delivery, we won’t accept return or replacement or cancellation of such order once it is dispatched or processed.

• Non-Refundable: Products which are marked as not returnable are not cover under RRRE Policy.
• Buyer has to raise refund request with proper reason through our customer care or through MY account page of platform with in 1 (One) day or within the same day after receiving the product by buyer by contacting our customer care. Return is defined as the action of giving back the item purchased in the original condition to the seller along with the original packing, MRP “Maximum Retail Price” tags, Not activated, Note used or which may to be consider to accept the return request by seller which are purchased on this platform. On return of the product there are chances or replacement or refund based on the case, which may vary product to product. If seller disagrees a return request even there is a valid reason. Buyer can file a dispute directly on seller to our customer care. In case of product was delivered (in digital format like license code through email, message and in admissible digital format or downloaded) directly by the seller to buyer, (In this type of return request you have to raise return request through our customer care, GYS not liable for any delays or problem). Seller may reject the return or refund request raised by the buyer if reason is not valid or not to be consider.
• Virtual downloaded file: In case of downloadable files there is no return or refund after purchase. In case of any license purchase buyer is no allowed to cancel the order and there is no refund for such purchase.
• Replacement: Replacement of product is not allowed. We will refund the 100% actual cost to the user. It may under the sole discretion of platform provider only. It is applicable in case of tampered or defective license or data which is different from the actual within 1 (One) day or within the same day after receiving the product by buyer from our delivery partner by contacting our customer care. Reasons like tampered, different product not as shown on our platform may be consider after detailed investigation before accepting refund. In case of refund accepted within 7 business working days, buyer may get the refund amount of the product purchased as per the refund policy.

Exchange: Currently we are not facilitating any exchange policy. Exchange is a scheme offered by the seller on his own. Exchange means the seller may take the older or used product from the buyer and giving him new product or as mentioned under the product description. The benefit of exchange will be availed by buyer in from of cash discount which is directly provide by seller. Buyer has to pay the difference amount of original cost to exchange cost.

Refunds: There could be situations when customers or buyers request a refund of the payments made for the products or services purchased or availed after cancellation or returned of the same to seller on GYS website or on its mobile application. If the product is returned by buyer or cancelled by buyer the refund amount will be refunded back after deducting transaction charges, taxes or any other charges which may to be considered from the total paid for product to buyer actual mode of payment within 15 business working days. No refund will be allowed for International Users or for payment received out of India.

Refund if not available in case of the user or buyer not belongs to India once the fee or payment paid is irreversible – No refund is allowed or accepted if user is International.

• Time taken to refund: It will take 15 business working days for the refund after getting confirmation by the seller that product was received in good condition and actual condition (Time taken to refund = 15 business working days + time taken to get confirmation by seller). Our trusted payment gateway partners do not charge you for refunds. However, delivery charges, transaction charges, fees and tax charged for a captured payment will not be reversed.

35. Payment / settlement to seller or tutor:
    • Product (License/eBooks): Payment settlement to seller against the sale product on GYS will be settled within 7 business working days after completion of return or replacement period (Total time for settlement = 7 Business working days + Return or Replacement Time in days).
    • Service: Payment settlement to seller against the sale of service or course or any downloadable content on GYS for agreed share between GYS and seller and disbursement of such share will be settled as per the below table.

For example, M/s x company provides tuitions for subjects such as Math, Physics, Biology and Chemistry, including JEE exams. A student enrolls in their Class program plus JEE coaching for which the billing is as follows all values mentioned below are INR:

Tuition fee: Rs.48,450

Books: Rs.20,560

Maintenance fee or platform cost: Rs.5,000

Total Value of Invoice (excluding tax): Rs.74,010

Taxable value = Rs.53,450 (Rs.48,450 + Rs.5,000) where tax is applicable only on Tuition fee and Maintenance or platform cost.

CGST: Rs.4,811

SGST: Rs.4,811

Total GST charged: Rs.9,622

Total payable: Rs.83,632 (Rs.74,010 + Rs.9,622)

Reviews, Comments, Communications, feedback and other content: Users of this platform may allow to submit Reviews, Feedback, Comments, send Communications and other content, ideas, questions and suggestions. Such content shall not be illegal, obscene, threading, threatening, abusive, injuries to third parties, defamatory, infringement of intellectual property rights, political campaign, spam messages, virus links, commercial solicitation, any community-based messages, which effect the sovereignty and integrity of country, chain letter, any false messages, mislead, degrading the brand value or trade mark of any company. Such content which not suits or creates allegation or not deemed fit as per seller, third parties or our associates, such Reviews, Comments will be removed without your consent. You agree that you are completely responsible for Reviews, Comments posted on this platform, You will be directly liable to claim any damages or losses caused to the others based on your post, We are not liable for any such Reviews, Comments or any form of communications. If you find any such Reviews, Comments, communications bring it to our notice we will rectify or remove or block such Reviews, Comments and block such user.
