Condition to Sale

(Condition of Sale – between Seller and buyer)

  • This Bipartite Agreement is an agreement between Buyer (who registered as Customer or Buyer or Student) and Seller (Who registered as vendor) who make use of globalyogaschools.com platform provided by Yuvaan IT Labs Private Limited (Hereinafter referred as “GYS®”).  As a customer or buyer or student (Collectively referred as “Buyer” or “You” or “Your”) read these conditions carefully before placing an order for any products (which includes services, and any other materials or virtually products) with the Sellers (“We” or “Our” or “Us”, wherever applicable) on the globalyogaschools.com (the website) and GYS® Mobile application (hereinafter the website and GYS® Mobile application Collectively referred as “Platform”) for “Transaction”. (Transaction includes both Buying and Selling on this Platform). These conditions signify your agreement to be bound by these conditions. Before placing any order or performing any transaction on this platform both seller and buyer wound bind to this Bipartite Agreement in continuation with terms of usage or Terms and conditions to make use of this platform. (Order includes purchase of subscription, registering for course or any such purchases)
  • In addition, when you use of any current or future globalyogaschools.com service (like Wishlist or Marketplace), you will also be subject to the terms or terms and conditions, and conditions applicable to that service (“Terms”). If these Conditions of Sale are inconsistent with such Terms, the Terms will control.
  • Conditions Relating to the Sale of Products to You: This section deals with conditions relating to the sale of products on the platform by us to you.
  • Our Contract: Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an e-mail confirming receipt of your order and containing the details of your order (the “Order Confirmation E-mail”) from us or from our platform providers. The Order Confirmation E-mail is acknowledgement that we have received your order and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer and conclude the contract of sale for a product ordered by you, when the product is dispatched to you and an e-mail confirmation is sent to you that the product has been dispatched to you (the “Dispatch Confirmation E-mail”). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation E-mail for each package, and each Dispatch Confirmation E-mail and corresponding dispatch will conclude a separate contract of sale between you and us for the product(s) specified in that Dispatch Confirmation E-mail. If you didn’t receive any dispatch email within 7 days, please write to the platform provider from contact us page or contact their customer care for further clarification and status about your order.
  • Your contract is with us (the Sellers) and you confirm that the product(s) ordered by you are purchased for your internal / personal purpose and not for re-sale or business purpose. If you are wholesale customer you can purchase as a wholesale customer but we or platform provider is nowhere liable for any infiltration in the market or any other discrepancies came out of such purchases made by you from us. Platform provider is creating a place to Us for selling our products to you. You authorize us to declare and provide declaration to any governmental authority on your behalf stating the aforesaid purpose of the products ordered by you on the platform. You can cancel your order for a product at no cost any time before we send the Dispatch Confirmation E-mail relating to that product. Please note that we sell products only in quantities which correspond to the typical needs of an average household. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity typical for a normal household. You can track your order from the tab available for order tracking tab. If we ship products ordered we will provide such tracking ID with you separately.
  • Returns: Please review our Returns Policy, which applies to products sold by us.
  • Pricing and availability: We list availability information for products sold by us on the platform, including on each product information page. Beyond what we say on that page or otherwise on the platform, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail if any products you order turn out to be unavailable. All prices are inclusive of VAT/CST, service tax, Goods and Services Tax (“GST”), duties and cesses as applicable – unless stated otherwise.
  • Taxes: You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties and cesses etc.
  • Health & Safety: By purchasing any product from our Home & Kitchen shop, you acknowledge that you have read and understood our Health & Safety Guidelines.
  • Children: Use of platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e., under the age of 18 years, you may purchase only with the involvement of a parent or guardian.
  • Communications: When you use platform, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by e-mail, SMS, phone call or by posting notices on the platform or by any other mode of communication. For contractual purposes, you consent to receive communications including SMS, e-mails, or phone calls from us with respect to your order.
  • B2B and B2C: we and you make use of this platform for our business purpose and personal purpose (buying and selling) purpose; whereas business transaction happen in between a seller and Buyer or Student, whereas the normal customer or buyer may transact for his own usage purpose and to resale the same. In case of Buyer or Student he may get the benefit of tax inputs as per Indian Laws and nowhere we or our platform providers not authorise you for the resale of products in market. It’s completely your discretion whether you transact on this platform for your personal usage or for any other purpose, we or our platform provider is not liable for any form of losses or damages or infiltration or any such things effect the market which was occurred due to resale of products purchased from us by using this platform.     
  • Wishlist: Products which added to your Wishlist are no longer reserved for you, and price mentioned at time of adding the product to your Wishlist may change time to time without any notice. The price shown at the checkout page is final and the same amount will be collected by out platform provider from you. In case of any mistakes happened from our end, it is under our sole discretion to cancel the order and we initiate the refund procedure through our platform provider. Here in any delay or cancellation of order or change in product price or any other discrepancy platform provider is nowhere liable for any damages or loss happened to you.
  • Losses: We and platform provider will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when a contract for the sale of goods by us to you was formed.
  • Governing Law and Jurisdiction: These conditions are governed by and construed in accordance with the laws of India. Kindly refer Terms of usage under 25. You agree, as we do, to submit to the exclusive jurisdiction of the courts at Nellore only.
  • Alteration or Amendments to the Conditions: We reserve the right to make changes to our policies, and these Conditions of Sale at any time or you can find this. Our platform provider also reserves full rights for any alterations or amendments without any notice. You will be subject to the policies and Conditions of Sale in force at the time you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
  • Events beyond our reasonable control: We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights. GYS®  is not liable for any losses or damages.
  • Waiver: If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
  • Sellers try to ensure that stock is on hand for delivery, but, sometimes, a listed item will no longer be available by the time you place an order. If a seller can’t deliver, they should refund you promptly so that you can place a new order.
  • Sellers has to keep listings of limited stock items to a minimum. Sellers determine their own shipping charges for different shipping speeds.
  • You can find seller shipping charges on the seller’s profile page, which you can open by selecting the seller’s name on the product details page.
  • Pay-on-Delivery is only available for items sold by certain sellers, buyer have to see the details mentioned on the product page at time of adding the product to Cart.
